Abstract
The case of involves a judicial review application concerning the auction of a motor vehicle by the Malawi Revenue Authority. The claimant challenged the legality of the auction, arguing that notices published were ineffective due to inaccuracies and that the defendant failed to provide an opportunity for affected parties to be heard, thus violating principles of procedural propriety under the Constitution. The defendant contended that it acted within the scope of the Customs and Excise Act, maintaining that it had adequately informed owners about the sale of goods and had no further obligation under the circumstances. Ultimately, the court dismissed the claimant's application, finding no procedural impropriety in the defendant’s actions and ruling that the claimant had not established a basis for the claim.
